Jack Eichel
Tim successfully represented former Buffalo Sabres Captain, Jack Eichel (now playing with the Vegas Golden Knights), where the team refused Jack’s right to undergo the surgery of his choice, namely, an Artificial Disc Replacement (ADR) rather than a permanent neck fusion as demanded by the Sabres, a procedure which would have seriously compromised his hockey career. Tim, while working with Dr. Mark Lindsay, put together a team of the top neurosurgeons in North America to repudiate the untenable position advanced by the Sabres’ medical personnel. Serious issues arose over the interpretation of the Collective Bargaining Agreement (CBA) and the right of NHL players to control the course of their own medical treatments. Ultimately, just before the deadline for a news conference which included medical experts, to announce the launching of a lawsuit, Jack was traded to the Las Vegas Knights which approved the ADR surgery successfully performed by Dr. Chad Prusmack of Colorado. This case has raised a vitally important question for NHL players, namely, the right to make deeply personal decisions concerning their own bodies and medical treatment and care. ADR is now the norm in the NHL.
